MINUTES OF PROCEEDINGS

The House met at three o’clock.

    PRAYERS were read by the Lord Bishop of Bath and Wells.

Judicial Business

1.  Regina v. Benjafield (Appellant) (On Appeal from the Court of Appeal (Criminal Division))—The appeal of Karl Robert Benjafield was presented and ordered to be prosecuted subject to the procedures applicable thereto (lodged 18th April).

2.  Regina v. Benjafield (Appellant) (On Appeal from the Court of Appeal (Criminal Division))—The appeal was set down for hearing and referred to an Appellate Committee.

3.  Barclays Bank plc (Respondents) v. Harris and another (AP) (Appellant)—Upon the death of the appellant on 22nd March last, the appeal abated in accordance with Standing Order X.

4.  Welsh (FC) (Respondent) v. Mayor and Burgesses of the London Borough of Greenwich (Petitioners)—The respondent’s certificate of public funding was lodged.

5.  Appeal Committee—The 47th Report was made; the Appeal Committee reported that they had met and had heard Counsel; the report was agreed to and the following Orders were made—

    Welsh (FC) (Respondent) v. Mayor and Burgesses of the London Borough of Greenwich (Petitioners)—That leave to appeal be refused; that the petitioners do pay to the respondent the costs of the petition; and that the costs of the respondent be taxed in accordance with the Access to Justice Act 1999, the amount thereof to be certified by the Clerk of the Parliaments if not agreed between the parties.

    Regina v. Durham County Council and others and another (Petitioner) ex parte Huddleston (Respondent)—That leave to appeal be refused; and that the petitioners do pay to the respondent the costs of the petition, the amount thereof to be certified by the Clerk of the Parliaments if not agreed between the parties.

6.  Negative Instrument—The following instrument was laid before the House and ordered to lie on the Table:

    Superannuation (Admission to Schedule 1 to the Superannuation Act 1972) Order 2001, laid under the Superannuation Act 1972.      (1587)

7.  Papers not subject to parliamentary proceedings—The following papers were laid before the House and ordered to lie on the Table:

    1.      Code of Practice for Registered Persons and Other Recipients of Disclosure of Information, laid under the Police Act 1997;

    2.      Accounts for 1999-2000 of the Scottish Children’s Reporter Administration, together with the Report of the Comptroller and Auditor General, laid under the Local Government Etc. (Scotland) Act 1994;

    3.      Accounts for 1999-2000 of the Scottish Executive Development Department: Non-Domestic Rating, together with the Report of the Comptroller and Auditor General, laid under the Local Government Finance Act 1992.

Public Business

8.  Select Committees—It was moved by the Chairman of Committees that the Lord Roper be appointed a member of the Committee of Selection and the House of Lords’ Offices Committee in the place of the Lord Harris of Greenwich deceased; the motion was agreed to.

9.  Armed Forces Bill—It was moved by the Baroness Symons of Vernham Dean that it be an instruction to the Committee of the Whole House to whom the Armed Forces Bill has been committed that they consider the bill in the following order:

11.  Health and Social Care Bill—The bill was further considered on report; amendments were moved and (by leave of the House) withdrawn; an amendment was disagreed to (see division list); it was ordered that the bill be printed as amended. (HL Bill 47)

12.  Community Legal Service (Funding) (Counsel in Family Proceedings) Order 2001—It was moved by the Lord Kingsland that an Humble Address be presented to Her Majesty praying that the Order, laid before the House on 20th March, be annulled (S.I. 2001/1077); after debate, the motion was (by leave of the House) withdrawn.

The House was adjourned at twenty-six minutes past ten o’clock

to Monday next, half-past two o’clock.
