THE BARONESS SECCOMBE

Insert the following new Clause—
  "Amendment to Education (No. 2) Act 1986
  In section 49 of the Education (No. 2) Act 1986 (c. 61) (appraisal of performance of teachers) in subsection (2)(a)(i) after "establishments" there is inserted—
"(aa)  to have regard to any guidance provided by the local education authority concerning matters to be taken into consideration in the appraisal of head teachers;""

    "(11)  The powers of the Secretary of State and the Chief Inspector under this section shall not be exercisable with the consequence that a school at which pupils of compulsory school age are registered shall be subject to inspection as part of an area inspection and to inspection under section 10 of the School Inspections Act 1996 (c. 57) at intervals of eighteen months or less."

  "School transport
(1)  The Education Act 1996 (c. 56) is amended as follows.
(2)  In section 509 (provision of transport etc.)—
(a)  subsection (2) is omitted;
(b)  in subsection (3), leave out all words after paragraph (b); and
(c)  subsection (4) is omitted."

  "Discipline on school transport
  Discipline on school transport shall be the responsibility of the school, or schools, whose pupils use that transport."

  "Welfare of pupils at a school
  In making arrangements for the welfare of pupils at a school, the governing body and head teacher shall have regard to Circular 10/95 issued by the Department for Education and Employment relating to the protection of children from abuse, or any circular replacing it."

  "Publication of statistics
  After section 496 of the Education Act 1996 (c. 56) there is inserted—
    "496APublication of statistics
      The Secretary of State may publish such statistics as she deems appropriate to inform the general public of the progress made by any element or elements of the statutory system of education, and shall ensure that, as far as reasonably practicable, such statistics are provided on the same basis in every year and that when changes are made in the basis of calculation, restated statistics are provided for the previous three years.""
