Select Committee on Religious Offences in England and Wales Written Evidence

Submission from the Law Society of Scotland

ECCLESIASTICAL JURISDICTIONS ACT 1860

I have taken soundings from the Criminal Law Committee and they confirm to me that offences which would be prosecuted under this Act in England and Wales would be prosecuted in Scotland under the common law offence of breach of the peace. A recent but unreported example is that of the photographer who attempted to take photographs of the popular entertainer Madonna's wedding which took place in Scotland last year.
