MINUTES OF PROCEEDINGS

The House met at half-past two o’clock.

PRAYERS were read by the Lord Bishop of Lichfield.

Judicial Business

1.  Watford Borough Council (Respondents) v. N’Wandou (Petitioner)—The petition of Simeon N’Wandou praying for leave to appeal notwithstanding that the time limited by Standing Order II has expired was presented without payment of the fee, such fee having been waived by the Appeal Committee pursuant to Standing Order XIII; the said petition was referred to an Appeal Committee.

2.  M (a minor) by her father and next friend (Respondent) v. Department of the Environment for Northern Ireland (Petitioners) (Northern Ireland)—The petition of the Department of the Environment for Northern Ireland praying for leave to appeal was presented and referred to an Appeal Committee.

3.  In re McKerr (Respondent) (Northern Ireland)—The petition of the Secretary of State for Northern Ireland praying for leave to appeal was presented and referred to an Appeal Committee.

4.  Regina v. Her Majesty’s Coroner for the Western District of Somerset (Respondent) and another (Appellant) ex parte Middleton (FC) (Respondent)—The petition of the appellant praying that the time for lodging the statement and appendix and setting down the cause for hearing might be extended to 10th March next (the agents for the respondent consenting thereto) was presented; and it was ordered as prayed.

5.  Appeal Committee—The following Orders were made pursuant to the 2nd Report:

    In re R and another (Petitioners)—That leave to appeal be refused.

    Hughes (Petitioner) and others v. Her Majesty’s Customs and Excise (Respondents)—That leave to appeal be refused; that the respondents be at liberty to apply for their costs in accordance with direction 5.1(d) and if the application is granted, that the amount thereof be certified by the Clerk of the Parliaments if not agreed between the parties.

    Hamilton v. Al Fayed (Petitioner) and others (Respondents)—That leave to appeal be refused; that the respondents be at liberty to apply for their costs in accordance with direction 5.1(d) and if the application is granted, that the amount thereof be certified by the Clerk of the Parliaments if not agreed between the parties.

6.  Appeal Committee—The 24th Report from the Appeal Committee was agreed to and the following Order was made—

    Floods of Queensferry Limited (Respondents) and another v. Shand Construction Limited (Petitioners) and others and one other action—That leave to appeal be refused; that the respondents be at liberty to apply for their costs in accordance with direction 5.1(d) and if the application is granted, that the amount thereof be certified by the Clerk of the Parliaments if not agreed between the parties.

7.  Instrument withdrawn—The following instrument, laid before the House on 9th January, was withdrawn:

    Draft Code of Recommendations for the Welfare of Livestock: Cattle.

8.  Paper withdrawn—The following paper, laid before the House on 30th January, was withdrawn on 7th February:

    Draft Code of Practice on the Video Recording with Sound of Police Interviews of persons detained under the Terrorism Act 2000.

9.  Command Papers—The following papers, having been presented to the House by command of Her Majesty on the 7th February, were ordered to lie on the Table:

10.  Statutory Instruments (Standing Order 71)—The following negative instruments, having been laid before the House on 7th February, were ordered to lie on the Table:

11.  Negative Instruments—The following instruments were laid before the House and ordered to lie on the Table:

12.  Papers not subject to parliamentary proceedings—The following papers were laid before the House and ordered to lie on the Table:

    1.  Report and Accounts for the period 1st February 2001 to 31st March 2002 of the British Railways Board, laid under the Railways Act 1974;

    2.  Report for 2001-02 of the Law Society for Northern Ireland Legal Aid Department, laid under the Legal Aid, Advice and Assistance (Northern Ireland) Order 1981;

    3.  Draft Code of Practice on Time Off for Trade Union Duties and Activities, laid under the Trade Union and Labour Relations (Consolidation) Act 1992.

Private Business

13.  London Local Authorities and Transport for London Bill [HL]—The bill was reported from the Unopposed Bill Committee with amendments.

Public Business

14.  Courts Bill [HL]—The House again resolved itself into a Committee upon the bill; amendments were moved and (by leave of the Committee) withdrawn; amendments were disagreed to (see division lists 1 and 2); the House was resumed after Schedule 3 stood part.

15.  Strategic Investment and Regeneration of Sites (Northern Ireland) Order 2003—The Northern Ireland Orders Grand Committee reported that it had considered the draft Order.

16.  Budget (Northern Ireland) Order 2003—The Northern Ireland Orders Grand Committee reported that it had considered the draft Order.

17.  Northern Ireland Arms Decommissioning Act 1997 (Amnesty Period) Order 2003—It was moved by the Lord Privy Seal (Lord Williams of Mostyn) that the draft Order laid before the House on 20th January be approved; after debate, the motion was agreed to.

18.  Terrorism Act 2000 (Continuance of Part VII) Order 2003—It was moved by the Lord Privy Seal (Lord Williams of Mostyn) that the draft Order laid before the House on 23rd January be approved; after debate, the motion was agreed to.

The House was adjourned at seven minutes before nine o’clock
