Bentham (Appellant) (On Appeal from the Court of Appeal (Criminal Division))—It was moved by the Lord Bingham of Cornhill, That the 26th Report from the Appellate Committee be agreed to; the motion was agreed to. It was ordered and adjudged that the Order of the Court of Appeal Criminal Division of 5th December 2003 be set aside; and that the Appellant’s conviction at Preston Crown Court on 5th September 2002 on count 2 (namely, possessing an imitation firearm during the course of robbery, contrary to section 17(2) of the Firearms Act 1968) be quashed. It was moved by the Lord Steyn, on behalf of the Lord Nicholls of Birkenhead, That the 27th Report from the Appellate Committee be agreed to; the motion was agreed to. It was ordered and adjudged that the orders appealed from be affirmed and the appeals dismissed with costs; and that the amounts thereof, if any, to be paid by the appellants and to be paid out of the Community Legal Service Fund be certified by the Clerk of the Parliaments in accordance with section 11 of the Access to Justice Act 1999; and that the costs of the appellants in this House be taxed in accordance with the Access to Justice Act 1999. 4.Law Society (Respondents) v. Sephton & Co (a firm) (Appellants) and another and others (Appellants) (England)—The appeal of Sephton & Co, James Arthur Sephton, Philip Leslie Houlston and Alexander William Gordon Cunningham was presented and it was ordered that in accordance with Standing Order VI the statement and appendix thereto be lodged on or before 21st April.
5.Secretary of State for the Home Department (Respondent) v. Hindawi (FC) (Petitioner) and another—The petition of Nezar Hindawi praying for leave to appeal was presented and referred to an Appeal Committee. The petitioner’s certificate of public funding was lodged (lodged 18th February).
