26Insert the following new Clause—
  "Proof necessary to drive HGV on restricted road
  After section 19 of the Road Traffic Act 1988 (c. 52) (prohibition of parking of HGV's on verges, central reservations and footways) insert—
    "19AProof necessary to drive HGV on restricted road
      A person shall not drive a heavy commercial vehicle (as defined in section 20 of this Act) on a restricted road (as defined in section 82 of the Road Traffic Regulation Act 1984) unless he has documentary proof of his need to drive on that road.""

27Insert the following new Schedule—
 

"SCHEDULE
YOUNG DRIVERS' SCHEME: PASSENGER CARRYING VEHICLES

 

Definitions

 1      In this Schedule—
     "the scheme" refers to the Passenger Carrying Vehicles Young Drivers' Scheme;
     "young people" refers to persons who have reached their 16th birthday but are not older than their 21st birthday;
     "licence holders" refers to young people who have obtained the necessary qualifications to drive passenger carrying vehicles as defined in section 89 of the Road Traffic Act 1988 (c. 52);
     "trainee" and "trainees" refers to young people who have joined the scheme.
 

Eligibility to join the scheme

 2      Young people, who are employed by a company licensed by the Traffic Commissioner to operate passenger carrying vehicles, may be eligible to join the scheme.
 

Training requirement

 3      In addition to the required passenger carrying vehicle driver training as defined in section 89 of the Road Traffic Act 1988, trainees must complete the Road Passenger Transport Level 2 qualification in England, Northern Ireland and Wales or a Scottish Vocational Qualification in Scotland.
 4      Trainees will be subject to four driving assessments within a period of 6 months from the date of passing the appropriate driving test before being allowed to carry passengers on unrestricted mileage in vehicles to their full authorised carrying capacity, or in the case of Category E passenger carrying vehicles with trailers appropriate to the licence category as defined in the Motor Vehicles (Driving Licences) Regulations 1996 (S.I. 1996/2824).
 

Registered employers

 5   (1)   Employers may apply to sponsors of the scheme to be registered as a training provider.
(2)      Registered employers must be companies registered at Companies House and must at the time of applying for registration employ young drivers for the purposes of providing training under the scheme.
 6      Registered employers must either—
(a)  operate their own vehicles under an "O" Licence (under the Public Passenger Vehicles Act 1981 (c. 14)), where an "O" Licence is required by law, held in the same name as the employer of the young driver or drivers, or
(b)  be an approved training organisation under the terms of the scheme and the trainee works at the premises of an "O" Licence holder.
 

Removal from the scheme

 7      Licence holders may be removed from the scheme if the conditions of their licence are breached under the terms of the Road Traffic Act 1988."
