The House met at half-past two o’clock.

PRAYERS were read by the Lord Bishop of Leicester.

Judicial Business

1.  Office of Fair Trading (Respondents) v. Lloyds TSB Bank plc and others (Petitioners) and others (Respondents)—The petition of Lloyds TSB Bank plc and Tesco Personal Finance Limited praying for leave to appeal was presented and referred to an Appeal Committee (lodged 24th April).

2.  Kola (FC) and another (FC) (Appellants) v. Secretary of State for Work and Pensions (Respondent)—The petition of the appellants praying that the time for lodging the statement and appendix and setting down the cause for hearing might be extended to 26th May (the agents for the respondent consenting thereto) was presented; and it was ordered as prayed (lodged 21st April).

3.  Appeal Committee—The 102nd Report from the Appeal Committee was agreed to and the following Orders were made—

    Starritt (Petitioner) v. Police Service of Northern Ireland (Respondents) (Northern Ireland)—That leave to appeal be refused; that the respondents be at liberty to apply for their costs in accordance with direction 5.1(d); and, if the application is granted, that the amount thereof be certified by the Clerk of the Parliaments if not agreed between the parties.

    Cartwright (Petitioner) v. Police Service of Northern Ireland (Respondents) (Northern Ireland)—That leave to appeal be refused; that the respondents be at liberty to apply for their costs in accordance with direction 5.1(d); and, if the application is granted, that the amount thereof be certified by the Clerk of the Parliaments if not agreed between the parties.

    R v. Tekie-Embaye (Petitioner)—That leave to appeal be refused.

    R v. Navabi (Petitioner)—That leave to appeal be refused.

    Ceredigion County Council (Respondents) v. Jones (FC) and others (FC) (Petitioners)—That leave to appeal be given; and that the petition of appeal be lodged by 6th June.

    Daltel Europe Limited (in liquidation) and others (Respondents) v. Makki (Petitioner) and others—That leave to appeal be refused; that the respondents be at liberty to apply for their costs in accordance with direction 5.1(d); and, if the application is granted, that the amount thereof be certified by the Clerk of the Parliaments if not agreed between the parties.

4.  Instrument withdrawn—The following instrument, laid before the House on 17th May, was withdrawn:

    Draft Human Tissue Act 2004 (Persons who Lack Capacity to Consent and Transplants) Regulations 2006.

7.  Paper not subject to parliamentary proceedings—The following paper was laid before the House and ordered to lie on the Table:

    Accounts for 2005 of the Crown Agents Holding and Realisation Board, together with the Report of the Comptroller and Auditor General, laid under the Crown Agents Act 1979.

Select Committee Reports

8.  Human Rights—The 20th Report from the Joint Committee, Legislative Scrutiny: Tenth Progress Report, on the following bills:

      Police and Justice Bill; and

      Compensation Bill [HL],

    was made and ordered to be printed. (HL Paper 186)

9.  Merits of Statutory Instruments—The following Report from the Select Committee was made and ordered to be printed:

    35th Report, on the following negative instruments:

      Transmissible Spongiform Encephalopathies (No. 2) Regulations 2006;

      Protection of Water Against Agricultural Nitrate Pollution (England) (Amendment) Regulations 2006. (HL Paper 187)

10.  Consolidation Bills--The First Report from the Joint Committee, on the Wireless Telegraphy Bill [HL], was made and ordered to be printed, together with the minutes of proceedings and the minutes of evidence. (HL Paper 188-I and II)

Private Business

11.  Leicester City Council Bill—The bill was brought from the Commons, read a first time and referred to the Examiners.

12.  Liverpool City Council Bill—The bill was brought from the Commons, read a first time and referred to the Examiners.

13.  Maidstone Borough Council Bill—The bill was brought from the Commons, read a first time and referred to the Examiners.

Public Business

14.  Armed Forces Bill—A bill to make provision with respect to the armed forces; and for connected purposes was brought from the Commons, read a first time and ordered to be printed. (HL Bill 113)

15.  Armed Forces Bill—It was ordered that the Explanatory Notes relating to the bill be printed. (HL Bill 113-EN)

16.  Legal Services—It was moved by the Chairman of Committes that the Commons message of Wednesday 17th May be now considered, and that a Committee of six Lords be appointed to join with the Committee appointed by the Commons to consider and report on any draft Legal Services Bill presented to both Houses by a Minister of the Crown; and that the Committee do report on the draft Bill by 25th July 2006;

    That, as proposed by the Committee of Selection, the following Lords be named of the Committee:

L. Campbell of Alloway
B. Falkner of Margravine
B. Henig
L. Hunt of Wirral
L. Neill of Bladen;
That the Committee have power to agree with the Committee appointed by the Commons in the appointment of a Chairman;

    That the Committee have leave to report from time to time, notwithstanding any adjournment of the House;

    That the Committee have power to appoint specialist advisers;

    That the Committee have power to adjourn from place to place within the United Kingdom;

    That the quorum of the Committee shall be two;

    That the reports of the Committee from time to time shall be printed, notwithstanding any adjournment of the House;

    And that the Committee do meet with the Committee appointed by the Commons on Thursday 25th May 2006 at 10.30 am;

    the motion was agreed to.

17.  National Lottery Bill—The bill was read a third time; amendments were agreed to; then the bill was passed and returned to the Commons with amendments.

18.  Company Law Reform Bill [HL]—The Queen’s and Prince of Wales’ consents were signified; the bill was read a third time; amendments were moved and (by leave of the House) withdrawn; amendments were agreed to; an amendment was disagreed to (see division list 1); amendments were agreed to (see division lists 2 and 3); a privilege amendment was agreed to; after debate, the bill was passed and sent to the Commons.

19.  Wireless Telegraphy Bill [HL]--The bill was reported from the Joint Committee with an amendment and re-committed to a Committee of the Whole House; it was ordered that the bill be printed as amended. (HL Bill 114)

20.  Legal Services—A message was brought from the Commons that they have ordered that the Committee appointed by them to join with a Committee of the Lords on any draft Legal Services Bill do meet the Committee appointed by the Lords on Thursday 25th May at half-past ten o’clock, as the Lords have proposed.

21.  Stroke victims: treatment—The Lord Rodgers of Quarry Bank asked Her Majesty’s Government what steps they intend to take to ensure the efficiency and effectiveness of the treatment of stroke victims, in light of the report of the Comptroller and Auditor General, Reducing Brain Damage: Faster access to better stroke care (HC 452); after debate, the question was answered by the Baroness Royall of Blaisdon.

The House was adjourned at twenty minutes past eight o’clock till tomorrow, a quarter before ten o’clock for judicial business,three o’clock for public business.
