The House resumed. 1 Hereditary Peers’ By-election The Clerk of the Parliaments informed the House that Earl Cathcart had been elected in accordance with the provisions of Standing Order 10 (Hereditary peers: by-elections) to fill the vacancy created by the death of Lord Mowbray and Stourton among the peers excepted from section 1 of the House of Lords Act 1999. The motion was agreed to. 8 Serious Crime Bill [HL] The bill was considered in Committee. Amendments 1 to 13 were considered. The House resumed. 9 Companies Act 2006 (Commencement No. 2, Consequential Amendments, Transitional Provisions and Savings) Order 2007 Lord Truscott moved that the draft Order laid before the House on 8 February be approved. Lloyd Limited (Respondents) (Scotland) It was moved by Lord Hope of Craighead, That the 17th Report from the Appellate Committee be agreed to; the motion was agreed to. It was ordered and adjudged that the appeal be allowed; that the Interlocutor of an Extra Division of the Inner House of the Court of Session in Scotland of 11 January 2005, the Interlocutor of Sheriff Principal Iain Macphail QC of 31 July 2003 and also the Interlocutor of Sheriff Kevin Drummond QC of 7 January 2003 be recalled; that the appellants’ first and fourth pleas in law be sustained and the respondents’ fourth, fifth and seventh pleas in law be repelled; that decree of declarator in terms of the first crave of the initial writ and also decree for payment of the sum sued for in terms of the third crave of the initial writ be granted; and that the question of the costs of the appeal to this House and of the expenses in the courts below be adjourned in order that the parties may make written submissions within 14 days.
