I am writing in response to your letter of 10
July 2006[154]
concerning the Interinstitutional Agreement (IIA) on the operating
framework for the European Regulatory Agencies and the use of
Article 308.
I apologise for the delay in replying to your
letter of 13 October 2005.[155]
In your letter, you requested a copy of any revised IIA text and
further clarification of the Government's position on the use
of Article 308.
Since Douglas Alexander's letter of 19 July
2005, no progress has been made on the Commission's proposal and
the IIA text has not been revised. We will keep the Committee
informed of any future developments.
With regards to the debate on the use of Articles
95 of 308 of the EC Treaty, the Government is currently considering
its position in light of the judgment of the European Court of
Justice in the European Network and Information Security Agency
(ENISA) case (C217/04). We will update the Committee when this
process is finalised.
