Consumer Emissions (Climate Change) Bill [HL]

Bill

To

Make provision, with regard to greenhouse gases, for the setting of a United

Kingdom consumer emissions target and for the reporting of United Kingdom

consumer emissions. 

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and

consent of the Lords Spiritual and Temporal, and Commons, in this present

Parliament assembled, and by the authority of the same, as follows:—

Consumer emissions target

(1)   

The Climate Change Act 2008 is amended as follows.

(2)   

After section 3 insert—

“3A     

Consumer emissions target

(1)   

The Secretary of State shall, by order, set a target for net UK consumer

emissions for the year 2050 (the “consumer emissions target”).

(2)   

It shall be the duty of the Secretary of State to ensure that the consumer

emissions target is met by 2050.

(3)   

When setting the carbon budget under section 4(1)(a), the Secretary of

State must have regard to the consumer emissions target.

(4)   

An order made under subsection (1) shall be made by statutory

instrument and may not be made unless a draft of the instrument has

been laid before and approved by a resolution of each House of

Parliament.

3B      

Consultation on the consumer emissions target

(1)   

Before laying before Parliament a draft of a statutory instrument

containing an order made under section 3A(1), the Secretary of State

must—

(a)   

obtain, and take into account, the advice of the Committee on

Climate Change, and

(b)   

take into account any representations made by other national

authorities.

(2)   

The Committee must, at the time it gives its advice to the Secretary of

State, send a copy to the other national authorities.

(3)   

As soon as is reasonably practicable after giving its advice to the

Secretary of State, the Committee must publish that advice in such

manner as it considers appropriate.

(4)   

The Secretary of State may proceed to lay such a draft statutory

instrument before Parliament, without having received a national

authority’s representations, if the authority does not provide them

before the end of the period of three months beginning with the date

the Committee’s advice was sent to the authority.

(5)   

At the same time as laying such a draft statutory instrument before

Parliament the Secretary of State must publish a statement setting out

whether and how the order takes account of any representations made

by the other national authorities.

(6)   

If the order makes provision different from that recommended by the

Committee, the Secretary of State must also publish a statement setting

out the reasons for that decision.

(7)   

A statement under this section may be published in such manner as the

Secretary of State sees fit.”

(3)   

In section 15(1) after subsection (a) insert—

“(aa)   

the target as set by order under section (3A)(1), or”

Reporting of consumer emissions and interpretation

(1)   

The Climate Change Act 2008 is amended as follows.

(2)   

In section 16(2)(a)—

(a)   

after first “emissions” insert “UK consumer emissions,”

(b)   

after “removals” insert “net UK consumer emissions”

(3)   

In section 20(2)—

(a)   

after first “emissions” insert “UK consumer emissions,”

(b)   

after “removals” insert “net UK consumer emissions”

(4)   

In section 29(1), after paragraph (a) insert—

“(aa)   

“UK consumer emissions”, in relation to a greenhouse gas,

means emissions of that gas from the production, supply and

use of all goods and services consumed by UK residents,

including imported goods and services where emissions of that

gas have in part occurred outside the UK;”

(5)   

In section 29(1), after paragraph (b) insert—

“(ba)   

the “net UK consumer emissions” for a period, in relation to a

greenhouse gas, means the amount of UK consumer emissions

of that gas for the period reduced by the amount for the period

of UK removals of that gas;”

3       

Short title, extent and commencement

(1)   

This Act may be cited as the Consumer Emissions (Climate Change) Act 2010.

(2)   

The Act extends to the whole of the United Kingdom.

(3)   

This Act shall come into force on the day on which it is passed.
