“( ) In relation to a transfer of functions, duties or powers under section 1 or section 5, or to mergers under section 2, the Transfer of Undertakings (Protection of Employment) Regulations 2006 (S.I.2006/246) apply to a transfer which relates to rights or liabilities under a contract of employment whether or not the transfer would, apart from this subsection, be a relevant transfer for the purposes of those regulations.

( ) In the case of an employee of any body whose functions, duties or powers are transferred or merged under section 1, 2 or 5—

(a) a period of employment with the transferor is to be treated as a period of employment with the recipient organisation;

(b) the transfer to the recipient organisation is not to be treated as a break in service.”
