Memorandum submitted by the Crown Prosecution Service

  At the evidence session on the 21 November 2007, the Director of Public Prosecutions agreed that the CPS Counter Terrorism Division would check their records to see if they were able to identify anyone upon whom they have advised pre charge and having been released by the police without charge, has subsequently been charged with any terrorist related offence. Unfortunately the records that exist generally identify pre charge arrests by operation name rather than individual suspects and it is impossible to use those records to identify anyone in this category.

  I have, however, checked the records myself and have a good working knowledge of the casework of the Division; using the records as an aide memoir, I do not believe that there is anyone who fits into that category.

  The CPS is unable to identify whether anyone who has been released following a terrorist investigation has been charged subsequently with a non terrorist offence and prosecuted on a CPS Area, or to say whether someone who has been released by the police without any CPS involvement has subsequently been charged with any offence, terrorist or otherwise.
