It was ordered and adjudged that the appeal be allowed and paragraph 4 of the Order of the Court of Appeal of 29 July 2005 set aside; and that consideration of paragraphs 1 to 3 of the said Order of the Court of Appeal relating to costs in that court and below and of the question of costs of the appeal to this House be adjourned in order that the parties may make written submissions within 14 days. 2 Inntrepreneur Pub Company (CPC) and others (Original Appellants and Cross-respondents) v. Crehan (Original Respondent and Cross-appellant) Further to the Order of the House of 19 July 2006 (70th Report Session 2005–06; [2006] UKHL 38), it was ordered that the Original Respondent and Cross-appellant do pay to the Original Appellants and Cross-respondents their costs in this House and in Her Majesty’s Court of Appeal, the amounts of such costs, if any, to be paid by the Original Respondent and Cross-appellant and to be paid out of the Community Legal Service Fund to be certified by the Clerk of the Parliaments for those costs incurred in this House and to be determined by a Costs Judge for those costs incurred in Her Majesty’s Court of Appeal, in each case in accordance with section 11 of the Access to Justice Act 1999 and the Community Legal Service (Cost Protection) Regulations 2000; that the costs of the Original Respondent and Cross-appellant in Her Majesty’s Court of Appeal be taxed in accordance with the Access to Justice Act 1999; that, as regards costs in the High Court of Justice Chancery Division, paragraphs 4 to 7 of the Order of Mr Justice Park in the High Court of Justice Chancery Division apply, the said Order having been affirmed by the Order of this House of 19 July 2006; and that there be no order as to the costs of the interveners.
