amendment to the original motion to leave out all the words after that and insert this House, having regard to the widespread concerns that the draft Regulations compromise religious liberty and will result in litigation over the content of classroom teaching, and having regard to the legality of the equivalent regulations for Northern Ireland, declines to approve the Equality Act (Sexual Orientation) Regulations 2007. After debate, the amendment was disagreed to (see division list). Then the original motion was agreed to.

It was moved by Lord Bingham of Cornhill, that the 19th Report from the Appellate Committee be agreed to; the motion was agreed to. In the appeal of the Secretary of State for the Home Department, it was ordered and adjudged that the Order of the Court of Appeal of 1 March 2005 be affirmed and the appeal dismissed; that the appellant do pay or cause to be paid to the respondent her costs in this House, the amount thereof to be certified by the Clerk of the Parliaments if not agreed between the parties: and that the costs of the respondent be taxed in accordance with the Access to Justice Act 1999.
In the appeal of Kashmiri, it was ordered and adjudged that the appeal be allowed; that the Order of Her Majestys Court of Appeal of 1 March 2005 and also the determination of the Immigration Appeal Tribunal notified on 18 May 2004 be set aside and that the cause be remitted to the Asylum and Immigration Tribunal for determination in the light of the opinions expressed in this House; that the respondent do pay or cause to be paid to the appellant his costs of the appeal to Her Majestys Court of Appeal and to this House, the amount of such costs in Her Majestys Court of Appeal to be determined by a Costs Judge and the amount in this House to be certified by the Clerk of the Parliaments if not agreed between the parties; and that the costs of the appellant be taxed in accordance with the Access to Justice Act 1999.
