Judicial Business 1 Al-Skeini and others (Respondents) v Secretary of State for Defence (Appellant) 2 Al-Skeini and others (Appellants) v Secretary of State for Defence (Respondent) (Consolidated Appeals) It was moved by Lord Bingham of Cornhill, That the 35th Report from the Appellate Committee be agreed to; the motion was agreed to. It was ordered and adjudged that the Order of Her Majesty’s Court of Appeal of 21 December 2005 be affirmed and the Appeals of the Secretary of State for Defence and also of Mr Al-Skeini and others be dismissed; that the claim of Mr Daoud Mousa be remitted to the Divisional Court of the Queen’s Bench Division of the High Court of Justice in accordance with the Order of Her Majesty’s Court of Appeal of 21 December 2005; and that the question of costs in this House be adjourned in order that the parties may make written submissions within 14 days. [2007] UKHL 26 3 Small (Her Majesty’s Inspector of Taxes) (Respondent) v Mars UK Limited (Appellants) Further to the Order of the House of 28 March 2007 (23rd Report Session 2006-07; [2007] UKHL 15) it was ordered that the respondent do pay or cause to be paid to the appellants their costs in this House, the amount of such costs to be certified by the Clerk of the Parliaments if not agreed between the parties, and also their costs in Her Majesty’s High Court of Justice Chancery Division, the amount of such costs to the determined by a Costs Judge if not agreed between the parties. 4 McCaughey (AP) (Appellant) v Chief Constable of the Police Service of Northern Ireland (Respondent) (Northern Ireland) Further to the Order of the House of 28 March 2007 (22nd Report Session 2006-07; [2007] UKHL 14) it was ordered that the respondent do pay or cause to be paid to the appellant his costs in this House, in Her Majesty’s Court of Appeal in Northern Ireland and in the Queen’s Bench Division of the High Court of Justice in Northern Ireland, the amount of such costs in this House to be certified by the Clerk of the Parliaments if not agreed between the parties and the amount of such costs in the courts below to be determined by the Taxing Master if not agreed between the parties; and that the costs of the appellant be taxed in accordance with the Legal Aid, Advice and Assistance (Northern Ireland) Order 1981. 5 Jordan (AP) (Appellant) v Lord Chancellor and another (Respondents) (Northern Ireland) Further to the Order of the House of 28 March 2007 (22nd Report Session 2006-07; [2007] UKHL 14) it was ordered that the respondents do pay or cause to be paid to the appellant 80 per cent of his costs in this House, the amount of such costs to be certified by the Clerk of the Parliaments if not agreed between the parties; and that the costs of the appellant be taxed in accordance with the Legal Aid, Advice and Assistance (Northern Ireland) Order 1981. 6 Her Majesty’s Revenue & Customs (Respondents) v William Grant & Sons Distillers Limited (Appellants) (Scotland) Further to the Order of the House of 28 March 2007 (23rd Report Session 2006-07; [2007] UKHL 15) it was ordered that the respondents do pay or cause to be paid to the appellants their costs in this House, the amount of such costs to be certified by the Clerk of the Parliaments if not agreed between the parties, and their expenses in the Extra Division of the Inner House of the Court of Session in Scotland, as taxed by the Auditor if not agreed between the parties.
