Examination of Witnesses (Questions 5800 - 5819)

  5800. MS JONES: Correct.

  5801. CHAIRMAN: You would like something else?

  5802. MS JONES: Correct.

  5803. CHAIRMAN: Have you got a text of what you would like?

  5804. MS JONES: I can get that photocopied over lunch. I also have the copy which I sent to the Promoter in 2006. The text deals specifically with the individual items. I apologise, I did not realise you would all need copies of the actual text.

  5805. CHAIRMAN: I do not think we are going to follow this. This is complicated legal stuff, and coming from you it jolly well should be! I do not think we are going to follow it unless we have got the rival texts in front of us.

  5806. MS JONES: How would you like me to deal with this? Would you like me to get the copies of the text?

  5807. CHAIRMAN: We have got the rest of the day and we have got photocopying facilities in their Lordships' House, if we adjourn now I am sure we can get the rival texts ready so that we can look at them this afternoon. Would that be alright?

  5808. MS JONES: I can certainly do that.

  5809. CHAIRMAN: If the Promoters did draft any response in 2006 that will presumably be produced by you, Mr Mould?

  5810. MR MOULD: I am going to make enquiries about that. What you do have, of course, is the up-to-date draft Settlement Deed that we have promoted which is in the appendix to your Information Paper D12. I gave you some references to that document last week if you recall when I closed the case.

  5811. CHAIRMAN: That is going to be one of the things we have. Ms Jones's rival version is going to be the other thing.

  5812. MR MOULD: Indeed, so. I am obviously all agog as to what that will say. Ms Jones will no doubt provide me with a copy of that during the course of the next hour or so.

  5813. CHAIRMAN: I believe we had better leave the parties to get on with this exercise. I do not know how long you think it will take; you must be allowed to have something to eat as well. It is 12.25 now, could we deal with it at 2.30?

  5814. MR MOULD: Yes, I would have thought so. That is fine as far as I am concerned.

  5815. CHAIRMAN: That is what we will do, because we are not going to get any further on this basis I promise you. We will adjourn until 2.30.

After the luncheon adjournment

  5816. CHAIRMAN: Let us proceed. Ms Jones, we have now got a copy of the original Deed of Settlement and it has a number of amendments. I think these come from you?

  5817. MS JONES: Correct.

  5818. CHAIRMAN: Could you explain to us exactly what you have done? First of all, you have put in manuscript amendments.

  5819. MS JONES: Yes.
