Examination of Witnesses (Questions 11840 - 11859)

  11840. At paragraph 3.1.3, "Under questioning, CLRL have acknowledged their geological information in this area is incomplete and that further investigations are needed. Nonetheless it is a concern in terms of risk management that CLRL propose at this stage to use a tunnelling machine type which might not be able to handle this ground rather than making a conservative choice. This decision may in turn have some bearing on their choice of tunnelling strategy. This issue will not be satisfactorily resolved. It is interesting that the Planning Inspector ... ", and we have submitted the information on the Channel Tunnel Planning Inspector's report, " ... deemed it necessary to note at paragraph 10 that the construction arrangements have to be sufficiently well defined to enable a proper assessment of their likely impact to be made. Two factors are pointed out by the Planning Inspector showing the NEWT principle to be defective. NEWT does not apply where the undertaker of the project is obliged to adopt a variation because of a change in the external circumstances of the project beyond the control of London and Continental ... ."—

  11841. CHAIRMAN: Ms Khela, let me try and get this clear. You are reading from a document prepared by a firm called Arup?

  11842. MS KHELA: No.

  11843. CHAIRMAN: What are you reading from because we do not know?

  11844. MS KHELA: I apologise, I assumed it was on the board.

  11846. MS KHELA: I am now referring to the Channel Tunnel Rail Link Planning Inspector's report—

  11847. MR ELVIN: I am sorry, Ms Khela. My Lord, I have just been over to ask the same question and it appears this is a list of undertakings which have been prepared by the Association to put to your Lordships, so this is a document we have not yet received.

  11848. MS KHELA: I apologise, I hope you have it now.

  11849. MR ELVIN: I think the Committee might need it, Ms Khela.

  11850. MS KHELA: (Document handed to Committee) Our major concern is the settlement deed provides for material damage whereas the Channel Tunnel Rail Link provided for any damage. We—

  11851. CHAIRMAN: Is this what you are asking us for?

  11852. MS KHELA: No. I am still going—

  11853. CHAIRMAN: We cannot give the undertakings. Are you asking us to recommend these undertakings should be given?

  11854. MS KHELA: We have paid £20 on the basis that as counsel is not doing that we have been told the House of Lords Committee on the Channel Tunnel Rail Link did ensure that the Promoters provide suitable undertakings for concerns that petitioners raised.

  11855. CHAIRMAN: Which ones do you want us to recommend?

  11856. MS KHELA: These are the main undertakings we have requested but we have amended those on the basis of further information which has been provided which is in the Additional Undertakings, so we have added to that list on the basis of the inadequacy we believe of the information which has been presented in a sensitive area such as Spitalfields.

  11857. MR ELVIN: Could we have a copy of the ones—

  11858. MS KHELA: You have already had that. You had it in 2007.

  11859. MR ELVIN: I am sorry, Ms Khela, I am not trying to be difficult, I am just not psychic. If you can identify it and we have it in the documents, fine, but I just need to find it. That is all.
