13140. MR GOODMAN: My Lord, I am sorry
if that was not clear. I am representing the Mayfair residents'
group and the Coalition which does include the Woodseer and Hanbury
Residents' Association, but I am not aware of the Petition made
by that Association specifically.
13141. CHAIRMAN: At the moment let's
stay with your presentation.
13142. MR GOODMAN: Your Lordship did
invite me to put any points to Mr Berryman and I have a handful
of those and then we can conclude.
13143. CHAIRMAN: I did indeed because
I thought you might like to look at the list of undertakings.
13144. MR GOODMAN: Yes. I will ask a
few questions in response to the evidence given by Mr Berryman.

GOODMAN
13145. MR GOODMAN: Mr Berryman, on the
subject of various undertakings that were given to us this morning,
it is correct, is it not, that there are not any specific undertakings
relating to the Mayfair area?
(Mr Berryman) Gosh,
that is a bit of a trick question.
13146. MS LIEVEN: I think that is probably
a question for me rather than Mr Berryman. We were asked to produce
this in respect of Spitalfields and so it deals with Spitalfields
specifically. The first section, which is generic assurances,
is applicable across the entire route. A similar table could be
drawn up for Mayfair. This was asked for in respect of Spitalfields
and so it is done in respect of Spitalfields. I think somewhere
in the course of the afternoon you are going to be given a note
on generic assurances generally. Do you remember you asked for
that a couple of weeks ago?
13147. CHAIRMAN: I did.
13148. MS LIEVEN: Mr Goodman is not as
familiar with the background to all of this as I am.
13149. CHAIRMAN: There will be a number
of generic undertakings and also presumably parts of the ERM which
relate to Mayfair as well as to everywhere else.
13150. MS LIEVEN: All the generic assurances
relate to everywhere and so by definition they relate to Mayfair.
There are some specific assurancesI am just trying to think
what they would bethat relate to Mayfair. Let us raise
one that came up this morning, e.g. Hanover Square. I know there
is an assurance on the record, it was probably to Westminster,
that there will be no tree loss in Hanover Square.
13151. CHAIRMAN: Have you been asked
by the Society and the Mayfair residents to give undertakings
about anything?
13152. MS LIEVEN: My Lord, we have had
this very long petition raising lots and lots of different issues,
but what we have not had at any of their appearancesand
there have been a few of them by nowis a schedule being
produced before a Committee saying, "These are the specific
assurances on these issues we want from the Committee"; we
have never had that document in that form. The concerns that have
always been raised are about alternatives and about not building
the Bond Street congestion relief scheme. We have not had it in
a form which would be easy to put up and deal with.
13153. LORD BROOKE OF ALVERTHORPE: So
there is an opportunity for Mr Goodman and the residents to request
similar treatment to what Spitalfields has had from your good
selves?
13154. MS LIEVEN: I am about to go off
instructions so everybody around me can scream if they are not
happy about this! I can see no difficulty in us saying that we
will produce a table equivalent to the one we gave you this morning
on Spitalfields for Mayfair which records all the existing assurances
which are specific to the Mayfair area. Can I get a nod from the
Department? Good. I am quite happy to have that. What we cannot
do is give further assured parliamentary assurances after this
Committee closes unless it is specifically recommended we do so.
In terms of producing a comparable table, I will say that we will
do that.
(Mr Berryman) But not today, my Lord.
13155. LORD BROOKE OF ALVERTHORPE: I
assume Mr Goodman is prepared to accept that it cannot be done
today.
13156. CHAIRMAN: But they have already
been given. I cannot understand why it is they are not known.
13157. MR GOODMAN: Those behind me are
certainly of the view that requests for undertakings and assurances
have been made. It may be a matter of the clarity of communication,
but that is certainly the view of those behind me, that requests
have been made at various stages throughout this Bill. I cannot
go any further with it than that.
13158. CHAIRMAN: What we have been told
is there is a list of assurances and undertakings.
13159. MR GOODMAN: Yes, not to my clients,
but a list of those that have been given to Westminster and so
on.
