Retail Development Bill [HL]
20. This private member's bill is, in particular,
to provide support for small retail premises and to make provision
about retail planning and development. There are powers for the
Secretary of State to make regulations at clauses 2(2), 6(2),
14(2) and (3), 15(6), 17(2) and (3), 21(4), 23(9) and (10), 26(2)
and (3) and 27. Those powers are subject to negative procedure,
apart from that at clause 6(2) which is subject to affirmative
procedure. Local authorities are required by clause 3 to establish
schemes and the Office for Retail Planning is required by clause
7 to prepare procedural rules; there is no parliamentary procedure
in either case. There is nothing in the delegations which we wish
to draw to the attention of the House.
