2Helow (AP) (Appellant) v Secretary of State for the Home Department and another (Respondents) (Scotland) It was moved by Lord Hope of Craighead that the 72nd Report from the Appellate Committee be agreed to; the motion was agreed to. It was ordered and adjudged that the Interlocutor of an Extra Division of the Court of Session in Scotland of 16 January 2007 be affirmed and the Appeal dismissed; that the question of costs be adjourned in order that the parties may make written submissions within 14 days; and that the expenses of the appellant in the Court of Session in Scotland and her costs in this House be taxed in accordance with the Legal Aid (Scotland) Act 1986. 4EM (Lebanon) (FC) (Appellant) v Secretary of State for the Home Department (Respondent) It was moved by Lord Hope of Craighead that the 74th Report from the Appellate Committee be agreed to; the motion was agreed to. It was ordered and adjudged that the appeal be allowed; that the Order of Her Majesty’s Court of Appeal of 21 November 2006 and also the determination of the Asylum and Immigration Tribunal notified on 2 December 2005 be set aside; that the decision of the Secretary of State promulgated on 21 February 2005 be quashed; that the question of costs be adjourned in order that the parties may make written submissions within 14 days; and that the costs of the appellant in this House be taxed in accordance with the Access to Justice Act 1999. 5Gallagher (Valuation Officer) (Respondent) v Church of Jesus Christ of Latter-day Saints (Appellants) Further to the Order of the House of Wednesday 30 July 2008 (66th Report, Session 2007-08; [2008] UKHL 56) it was ordered that the appellants do pay or cause to be paid to the respondent his costs of the appeal in this House, the amount of such costs to be certified by the Clerk of the Parliaments if not agreed between the parties.
